(the “Site”). The following Terms of Service (“Terms”) govern your access to and use of the Site. Any use of the services provided by Tunetradr Records shall be subject to the Tunetradr Digital Distribution Services Agreement. By accessing or using the Site, you agree to be bound by these Terms.
Tunetradr Records Private Limited (“Tunetradr Records”, “Tunetradr”, “we”, “us”, or “our”) provides the Services (as defined below) to users (“you” or “your”) through its web-based platform available on the Site. By accepting these Terms or by accessing or using the Site and Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, including the Tunetradr Records Privacy Policy, Distribution Agreement, and any other legal terms listed on the Site.
If you are entering into these Terms on behalf of a company or legal entity, you represent that you have authority to bind such entity. If you do not agree with these Terms, you must discontinue use of the Site and Services.
Tunetradr Records reserves the right to modify these Terms from time to time by providing prior notice via email or by posting a notice on the Platform. Revised Terms will become effective thirty (30) days after notice. Continued use of the Services after such date constitutes acceptance of the revised Terms.
1. DEFINITIONS
For purposes of these Terms:
(a) Content means album artwork, lyrics, metadata, images, graphics, text, descriptions, and other materials uploaded by Users.
(b) Distribution Plan means the distribution service plan selected by the User.
(c) Platform means Tunetradr Records’ proprietary digital distribution platform and related technology.
(d) Services include:
Digital distribution of Songs and Videos to authorized streaming and download platforms;
Collection and payment of royalties under the selected Distribution Plan;
Marketing, promotional, analytical, and reporting services.
(e) Song(s) means sound recordings (including underlying compositions) uploaded by Users.
(f) User(s) means any individual or legal entity accessing or using the Site or Services.
(g) Video(s) means audiovisual recordings uploaded for distribution.
2. USE OF THE SITE, PLATFORM & SERVICES
(a) Your use of the Site constitutes a limited, personal, non-transferable license.
(b) Services are intended for individuals aged 18 or above or legal entities capable of entering contracts.
(c) You may not:
Reproduce, distribute, or commercially exploit any Platform software or content;
Reverse engineer or decompile Platform technology;
Remove copyright notices;
Upload or distribute content you do not own or control;
Interfere with or manipulate the Platform or Services.
(d) Any violation may result in immediate termination of access and legal action.
(e) Tunetradr Records does not guarantee accuracy, completeness, or availability of the Site or Services.
3. OWNERSHIP & INTELLECTUAL PROPERTY
(a) Tunetradr Records retains all rights, title, and interest in the Site, Platform, and Services.
(b) All trademarks, logos, and service marks of Tunetradr Records are protected. No license is granted without written consent.
(c) User Content License
By using the Services, you represent that you own or control all rights to the Songs, Videos, and Content you upload and grant Tunetradr Records a license to distribute such content digitally. You agree to indemnify Tunetradr Records against any claims arising from your Content.
4. INTELLECTUAL PROPERTY VIOLATIONS
Tunetradr Records responds to valid copyright infringement notices. Complaints must include:
Identification of infringing content;
Ownership proof and contact details;
Details of original content.
Tunetradr Records may suspend or terminate accounts of repeat infringers and may reinstate content at its discretion after review.
5. DATA USE & PRIVACY
(a) Tunetradr Records may use User data to:
Provide Services;
Perform analytics and internal operations;
Use anonymized data for business and marketing purposes.
(b) Tunetradr Records may use your name, image, or company name for promotional purposes unless you opt out via email.
(c) Any feedback you provide may be freely used by Tunetradr Records without compensation.

6. THIRD-PARTY WEBSITES
Tunetradr Records is not responsible for content on third-party websites linked through the Site. Access is at your own risk.
7. REPRESENTATIONS & WARRANTIES
You represent that:
You have authority to enter these Terms;
Your content does not infringe third-party rights;
You are at least 18 years old.
8. DISCLAIMER OF WARRANTIES
THE SITE AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. TUNETRADR RECORDS DOES NOT GUARANTEE UNINTERRUPTED SERVICE, ACCURACY, OR REVENUE GENERATION.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Tunetradr Records shall not be liable for indirect or consequential damages. Total liability shall not exceed the INR equivalent of USD $100.
10. INDEMNIFICATION
You agree to indemnify and hold harmless Tunetradr Records against claims arising from your breach of these Terms or your Content.
11. ASSIGNMENT
You may not assign these Terms without written consent. Tunetradr Records may assign freely.
12. MISCELLANEOUS
These Terms constitute the entire agreement between you and Tunetradr Records. No partnership or agency is created. Waivers must be in writing.
13. GOVERNING LAW
These Terms are governed by the laws of India. Courts in Mumbai shall have exclusive jurisdiction.
