These Terms of Service ("Terms") govern your access to and use of www.tunetradrrecords.com, our distribution platform and our services (the "Services"), operated by Tunetradr Records Private Limited ("Tunetradr", "we", "us"). By accessing or using the Services you agree to these Terms. We may modify them from time to time by giving prior notice via email or by posting a notice on the platform; continued use means you accept the changes.

1. Definitions

• Content — artwork, lyrics, metadata, images and text you upload.
• Songs / Videos — the sound recordings, compositions and audiovisual works you submit for distribution.
• Distribution Plan — the service tier you select.
• Platform — our proprietary digital distribution technology.
• Services — distribution to streaming platforms, royalty collection and payment, marketing and analytics.
• User / you — the individual or legal entity using the Services.

2. Use Of The Site, Platform & Services

We grant you a limited, personal, non-transferable licence to use the Services. They are available only to users aged 18 or over, or to legal entities. You agree not to:

• copy, reproduce, exploit or resell the platform software, or reverse-engineer it;
• remove or alter any copyright or proprietary notices;
• upload content you do not own or have no right to distribute; or
• interfere with, disrupt or attempt to gain unauthorised access to the Services.

Any violation may result in immediate termination of access and legal action. We do not guarantee the accuracy, completeness or uninterrupted availability of the Services.

3. Ownership & Intellectual Property

We retain all rights to the platform, the Services and our trademarks; nothing here grants you a licence to use them without our written consent. You represent that you own or control the Content you upload, and you grant Tunetradr a licence to distribute that Content digitally through the Services. You agree to indemnify us against any claims arising from your Content.

4. Intellectual-Property Violations

We respond to valid copyright complaints that identify the infringing material, provide proof of ownership and describe the original work. We may suspend or terminate the accounts of repeat infringers. To report infringement, use our infringement claim form.

5. Data Use & Privacy

We use your data to provide the Services, for analytics and for anonymised business and marketing purposes. We may use your name, image or company name for promotional purposes unless you opt out by email. Feedback you provide may be used without restriction or compensation. 6. Third-Party Websites

The Services may link to third-party sites and platforms we don't control. We are not responsible for their content or practices, and you access them at your own risk.

7. Representations & Warranties

You represent that you have the authority to enter into these Terms, that your Content does not infringe any third party's rights, and that you are at least 18 years old.

8. Disclaimer Of Warranties

The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant uninterrupted or error-free operation, the accuracy of results, or any particular level of streams or revenue.

9. Limitation Of Liability

To the maximum extent permitted by law, Tunetradr's total liability arising from the Services is limited to USD $100 (or its INR equivalent). We are not liable for any indirect, incidental, special or consequential damages, or for lost profits or revenue.

10. Indemnification

You agree to indemnify and hold Tunetradr harmless from any claims, damages or expenses arising out of your breach of these Terms or your Content.

11. Assignment

You may not assign or transfer your rights under these Terms without our consent. We may assign our rights and obligations freely, including in connection with a merger or sale.

12. Miscellaneous

These Terms, together with the policies referenced in them, are the entire agreement between you and Tunetradr. Nothing here creates a partnership or agency relationship. Any waiver must be in writing. If a provision is found unenforceable, the rest remains in effect.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. The courts in Mumbai shall have exclusive jurisdiction over any dispute arising from them.
